Directors can be disqualified from their positions for specific reasons pertaining to their industries. Any director who gets automatically disqualified under sections 34, 35, or 36 of Limited Liability Partnerships Act also gets disqualified under the Companies Act. Such an individual cannot act as a director or take part in the management of any company.

Directors in specific industries can be disqualified from their positions in companies under :

  • Payment Systems (Oversight) Act, Section 22
  • Insurance Act, Sections 31, 35ZJ or 41(1)(b)
  • Securities and Futures Act, Sections 44, 81A, 81ZJ or 97
  • Finance Companies Act, Sections 47 and 49
  • Banking Act, Sections 50, 54B, 66, or 67
  • Financial Advisers Act, Section 57
